Jersey Reform Day 1769-2020

Tom Gruchy

Today (17th September) is Jersey Reform Day, and as we have, in the past few years, we mark the (251st) Anniversary by reminding readers/viewers of its significance and ask the questions: "What has changed?" "Don't we still have the same so-called "democracy" we had back in 1769 that Tom Gruchy, and fellow islanders, were protesting about?" "Who really runs our Island? Many more questions are asked and mostly answered in the exclusive interview below.


This years interview with local historian/Human Rights Campaigner, and BLOGGER Mike Dun has an added twist due to the current Corona Virus measures/laws being introduced along with the police wanting all police officers to carry Taser Guns. How (as in 1769) are we able to gather in large numbers to overthrow a corrupt Royal Court or similar corrupt institution?

    1. Russell Labey has Trevor Pitman's old seat. He won't do anything to give credit to a far better politician. Labey has been such a let down with his cap-doffing to keeping the Bailiff. It is hard to know who in Pitman's old seat is worse, Labey or Wickenden.

  4. Mike's passion is so uplifting. He speaks so much sense - that (I think) he came almost last in the by-election a few years ago shows how damn stupid and easily misled so many people are. Mike would have been a great boost for the States and quite honestly his passion and common sense put most people in there today to shame.

  7. Mike would have been great to have in the States even for one term. Focussing on real, long term political issues is what we need. Goes without saying that for the same reasons we also need Trevor back too. And Shona if she is well enough after the car assault I read about on Twitter. We need dozens of these type of people if Jersey is to finally shake off the Jersey Way of the Bailiffs and big business interests.

    All of this criticism of our great court system is totally wrong. When I was in court for threatening to murder people via a drunken telephone call everyone was very nice. The judge let me write a secret note to him saying stuff that nobody else was allowed to hear. The police also let me slip away with a blanket over my head and the media never used my mug shot which they could have gotten easily. Gentlemen one and all. Nobody knows this but I was even allowed a can of Stella in the celler while I was waiting. The Jersey Way is great.

  12. When are Reform Jersey going to bring something to set right all of the electoral flaws highlighted two years ago by the visiting monitors? Isn't such REFORM just the sort of thing a party claiming to be REFORMERS should be doing? Why should parishers with one set of traffic lights have a much greater percentage of representation in the States than us in the island's capital? And that is just one example. So hows about you doing an interview with the party chairman Senator Mezec asking him about this, instead of all these chances for him to make excuses about the failings of his tenure as Childrens Minister? Just saying.

  15. How about an interview with Advocate Sinel? I find the action against him by the Jersey court staggering criticising this fine man for a minor matter when they take no action against their own serious failings. Bailiffs denigrating abuse victims in Liberation day sspeeches. Bailiffs allowing people who they were told covered up abuse to become Jurats. Bailiffs doing nothing when police were told by minions it was ok to illegally bug the car of a suspect. Hypocrisy, total hypocrisy.

That interview encapsulates pretty much ALL of what happened during Stuarts time and after, my only comment other than I wholeheartedly agree with what he said was that most of the Jersey people are not part of the coverup. That said they are perhaps complacent by way of the fact they do not speak out and perhaps more importantly get out and vote. But when we have a system where the majority of the authority in Jersey is not elected to their posts, there in lies the problem. I have always and will always be incensed that a person who was not elected had the crassness to turn off the microphone of a person I elected to represent me.

    1. As Stuart says, after years of experience in the bear pit itself, the real power lies in the hands of those who are untouchable because they make the rules.

      Jersey PLC is run on a superficial basis by the Office Managers (the States) but the Directors and Beneficial Owners are still the wealthy landowner and lawyer "Establishment" class, the feudal lords, just as it has always been for the past millennium or more.

      If you make the rules, apply them, appoint the judges to try anyone who crosses your path, deny them legal aid, supply new laws for the useful idiots in the assembly to approve, you run the show. The States simply tinker with the day to day stuff to give the illusion of some degree of democracy.

      And it's so well engineered, most of the useful idiots don't even realise that they're being played! To the extent that it sounds like conspiracy theory just to mention it. Neat trick, that.

  20. This posting is perhaps one of the most critical that this blog site will perhaps be able to shed light upon.
    Sir Philip Bailhache has again raised yet again the prospect of Jersey becoming independent of the UK government due to the latest UK decision regarding the right of fishing in Jersey waters.
    That is as may be but this posting is far more than that and it is simply about how we as an Island are governed, by that I mean our elected members but much more importantly our NONE elected government members.
    If we take the suggestion of 'so called' independence for this Island (I am deliberately not including the other Islands here)how on earth do the none elected Law Officers (i.e Bailiff, Deputy Bailiff, Solicitor General etc fit into this proposed new scenario as they are all appointed by the crown and therefore if we do go independent this would most definitively no longer be the case (As an aside I have always felt that in my opinion the law officers have been the real problem with Government reform for centuries)
    So Jersey becomes INDEPENDENT of the UK, what or who replaces the LAW OFFICERS, because they will most certainly have to be replaced by some other means if we are supposedly to become truly independent.
    Perhaps Mike Dunn or someone who has the knowledge to answer this question may like to suggest what would be the solution.
    I am like so many of my Islanders going to post this as 'Anonymous' that alone pretty much shows how the stain of the PTB hold over the people.

To suggest that governments operating from the idealogical position of the named Arbenz and Allende, and more importantly I would suggest, far more recent ones such as those of Cuba (and no I don't support all that regime has done), that of Evo Morales in Bolivia and the late Hugo Chavez in Venezuala show that governments can form and function for reasons other than profit for big business. Not least genuinely wanting a fairer world for the downtrodden. I must admit I would like to see Jersey's registration details. Maybe you can repeat if already posted?

This prize pair of idiots have lodged propositions that would do better if they just suggested Jersey becomes an official fascist state. 32 votes needed to alter the States in any way?   29. Hi Bloggers. This post has been up for a while now. From a personal angle I find some of the views a little depressing. Any chance of an interview with someone if no new topics are getting your juices boiling? I can't agree with the view that everything is corrupt and hopeless. There have been good people. There will be good people out there now. You wouldn't be doing what you do if that wasn't true. Maybe the former Jersey politician in your mugshot would share his current thoughts if you need a subject? Surely the key to everything is getting a few good people others could be inspired by to work together. Not easy I know. But I hold that it is true.

    1. It *is* depressing, yes, there's no getting away from that.

      But the truth remains that Jersey was strongly feudal for centuries, and only made *some* concessions in the form of the States Assembly and expanding who gets to vote.

      Very little else has changed, despite us fooling ourselves that we're far more sophisticated these days with our indoor plumbing and electricity, combustion engine transport, food and goods from around the world, and all the toys we amuse ourselves with.

      Who gets to prosecute or let an accused walk free? To decide on the judge if there's a trial? To deny representation? Were they elected? What oversight is there?

You don't like the sound or direction of the matters to hand so you automatically wish it will all go away if you bury your head in the sand for long enough! You all want change, but none of you are prepared to change yourselves or your traits? And anon below, we actually don't have ANY courts anywhere in Britain, all we have are administrative tribunals dealing with banking disputes between the Captain of the Ship and the mates (mister's). It's contract law governed by the Uniform Commercial Code. Thanks.

He hasn't blogged for five or six weeks which after a very long silence I initially hoped was a positive sign of his coming back on line. But perhaps he is just another one who has also given up on Jersey ever changing?

  33. Graeme Butcher was Constable of St John between 2006 - 2011. Three years later he was charged by the Attorney General's office with misconduct in public office for misappropriation of Parish funds and sent to prison by the Royal Court for six months.

    In 2020 the present Constable Chris Taylor of St John was convicted of dangerous driving banned from driving for 18 months and fined £4,000 although he pleaded not guilty and took his case to trial. He tried to use Parish funds to fund his legal costs.

    Apart from the fact a question mark hangs over his evidence he gave at trial, under oath, that was outweighed by the evidence of two cycle marshals, was his attempt to use the Parish funds also a misappropriation of Parish funds that led to the charge of misconduct in public office for the previous Constable?

    The Royal Court has set a date for a two-day hearing for Mr Taylor and the two Parish Procureurs to attend to be questioned about the initial use of Parish funds. Would this process be the norm for the man on the street, for example misappropriating funds of his employer, or more importantly, why did Mr Butcher not have the same opportunity as Mr Taylor to have his case heard in the Royal Court before he was charged because what the Attorney General did in his case, which is the norm, he carried out the evidential and public interest test on the decision to prosecute and charged Mr Butcher and sent his case to the Royal Court.

    So what would happen if it materialises within the two day hearing that they have attempted to misuse, misappropriate Parish funds whilst under questioning from the court? Will they be giving evidence under oath? Will they have legal representation? Would, or could the evidence then be used by the Attorney General's office to prosecute?

    If there is a question mark over the use of the Parish funds, and the Attorney General is asking the court to decide, wouldn't it be more appropriate to present the evidence to the States of Jersey Police to investigate the case and pass their findings back to the Attorney General to decide if there is a case to answer because it seems that the very same court that will be questioning the three people will be conflicted if there are any criminal charges brought that would end up back in the Royal Court.

    Will the two day hearing be open to the public?

    1. A further question to ask would be "has Constable Chris Taylor got parliamentary privilege?"

      We know, from when disgraced former Deputy Andrew Lewis was found to have told lies (under oath) by the Independent Jersey Care Inquiry, he was protected by parliamentary privilege and could NOT be charged with perjury like anybody else who might have lied under oath. Has Chris Taylor got the same protection?

      Isn't there another aspect to this though? I seem to recall that there is some kind of a rule where you can't self incriminate in court? Meaning whatever is said in the two-day court hearing can't be used as evidenc against them?

What the above brilliantly well made points make clear is that Trevor Pitman, and obviously is wife Shona too, was just wanted out by the establishment and its Royal Court was the ideal tool to achieve this. Imagine how these two would have been pilloried if they had behaved like Taylor, Butcher or Andrew Lewis. Put it this way, if I had been one of those the Pitmans took to court I wouldn't have wanted them made bankrupt. I would have been begging, demanding the court not to follow this course. As popular politicians they would almost certainly have both been in the States now. The important bit being that I would have had a good chance of getting my money back. Andrew Lewis should have been removed by any self-respecting court and Taylor likewise in my opinion because of what he was meant to have done in ramming a police cycle marshall. How fascinating to also reflect that has Butcher or Taylor been made bankrupt back in 2014 neither would have lost their seats because the law didn't apply to Constables.
