Press Release from Advocate Philip Sinel.




Local prominent Lawyer, Advocate Philip Sinel, who's damming submission to the Carswell Review featured as our PREVIOUS POSTING has today published a Press Release which we reproduce below.

The Press Release comes as a consequence of the prosecution against Advocate Sinel being dropped today for lack of evidence.

PRESS RELEASE 6 JUNE 2014

8 YEARS AGO I INTERVENED IN ORDER TO INTERRUPT A PHYSICAL ATTACK WITH A BLUNT INSTRUMENT ON MY ELDEST CHILD BY A FORMER MARTIAL ARTIST WHO HAD PREVIOUSLY BEEN DIAGNOSED BY A HOSPITAL PSYCHIATRIST AS HAVING AN EXPLOSIVE PERSONALITY DISORDER. 

I DID WHAT ANY RESPONSIBLE PARENT WOULD DO, THE ASSAILANT REQUIRED NO MEDICAL TREATMENT, NO COMPLAINT WAS MADE FOR 7 YEARS UNTIL AFTER A CLAIM FOR MONEY WAS MADE DURING OTHER PROCEEDINGS. 

UNDER THE CIRCUMSTANCES THE ATTORNEY GENERAL'S ACTION IN PUTTING MYSELF AND MY CHILDREN THROUGH THE STRESSES AND STRAINS INHERENT IN A CRIMINAL PROSECUTION CAN EASILY BE INTERPRETED AS A DELIBERATE ACT OF INTIMIDATION DESIGNED TO DETER MYSELF AND OTHERS FROM SPEAKING OUT ABOUT THE NEED FOR JUDICIAL REFORM AND ACCOUNTABILITY.

FROM THE ATTORNEY GENERAL'S POINT OF VIEW IT WOULD HAVE BEEN FORTUITOUS HAD MY REPUTATION BEEN TARNISHED BEFORE I HAD THE OPPORTUNITY TO GIVE EVIDENCE BEFORE THE FORTHCOMING PUBLIC ENQUIRY, AN ENQUIRY WHICH DEALS NOT ONLY WITH THE ABUSE OF VULNERABLE PERSONS IN OUR SOCIETY BUT ALSO WITH THE MANNER IN WHICH THOSE AND OTHER CRIMES HAVE BEEN COVERED UP.

OVER THE YEARS THERE HAVE BEEN NUMEROUS ATTACKS ON MY REPUTATION AND LIVELIHOOD, ALL BROUGHT AT THE EXPENSE OF THE TAX PAYER.  MY ESTIMATE OF THE COST TO THE TAX PAYER IS WELL OVER £1 MILLION.

THE FREQUENCY AND NATURE OF THOSE ATTACKS HAS INCREASED AFTER I OBTAINED AN ACQUITTAL OF TWO SENIOR POLICEMEN AT THE BEGINNING OF LAST YEAR.  THE CHARGES AGAINST THEM, LIKE THOSE AGAINST MYSELF, APPEARED TO BE POLITICALLY MOTIVATED AND DESIGNED TO INTIMIDATE AND DETER.(END)

  2. It was obvious to many, many people that Advocate Sinel was also having the 'Syvret treatment' meted out when this case was first made public. How plainly clear it is that those who do not conform will suffer the injustices of the Establishment and their judiciary system.

    Again, how much has this frivolous, failed case cost the taxpayer.

    Respect to Advocate Sinel for this Press Release which speaks a thousand words.

  3. They got Power, Harper, Syvret and the Pitman's. I can't see them stopping until they've destroyed Sinel and then the blogs. Massive thanks to Sinel for carrying on speaking out and telling the truth.

    1. I strongly believe that the days of 'The Jersey Way' are numbered. The number of cases indicative of foul play on the part of the authorities or the judiciary is growing. The blogs are improving in the nature of the editorial they are producing, and in the news they are receiving and publishing.

Oh, and I also forgot to mention that many of the people the authorities or the judiciary have picked on are able to fight their corner without having to rely on legal advisors that are both costly and prefer to avoid the kind of conflict that contesting cases involving judicial and administrative corruption generates.

    1. Lots of families and ordinary folk are victims of the Jersey corrupt courts. Unfortunately we only get to hear about the high profile figures but I bet there are THOUSANDS in Jersey who have been victims of the court corruption.

  5. One day I was in the royal court and mr spinel was there asking for a judgement . Clyde - smith treated him like dirt and asked what do you want me to do . He never asked the three lawyers before mr sinel what did they want him to do. Shame on the system .

    1. Advocate Sinel and Commissioner Clyde-Smith go back a long way: in March 1998, Advocate Sinel swore an affidavit to the effect the Royal Court was not capable of determining a case against his clients fairly to encourage the case to be tried in a US Court of Law instead.

      Arguably, the decision of Advocate Clyde-Smith, as he was then, to complain about Advocate Sinel's conduct was perhaps one of the reasons he was promoted to Commissioner: a staunch supporter of the local justice system.

  6. The Jersey Way exposed once again. Funny isn't it how in stark contrast an imported 'local' businessman was named by both the victim and the individual eventually convicted of abusing her as allegedly doing exactly the same - yet was never even taken to court by Jersey's Attorney General! Yes, it isn't what you do in Jersey as they say but WHO you are in doing it. Selective prosecutions - as it happened just one aspect of my initial evidence to the Jersey COI into the child abuse scandal. Not to forget that other Jersey 'justice' system phenomenon selective sentencing...

    Stuff like sex of the child and age at the time of the assault.
    Same details for the assailant.

    The nature of the blunt instrument.

    His relationship, if any, to the assailant.

    The nature of his defending action, was it proportionate?

    1. To be fair the questions are not totally irrelevant but this is a quality blog which concentrates on public interest and the big picture rather than what might be voyeuristic tittle-tattle or "gossip porn"
      This news site is not Jersey's equivalent of the Daily Mail, the Sunday Sport or JEP-Pravda. If there is any dirt or character assassination to be done "Anon" can expect to find it in Jersey's usual gutter media and establishment mouthpieces.

      There is little doubt that there is a vendetta against Mr. Sinel, and VFC's "Editorial decision" is justified.
      This flawed prosecution is only part of the vendetta against Mr. Sinel and you can expect more details to be released in due course.

      The hijack of the rule of law is a big story and be wary of anyone seeking distract or muddy the water.

      The ivory tower of the establishment has been built too high and even most Jersey lawyers can see that it is unsustainable and at the point of collapse. It is only a matter of time before they abandon pirate ship HMS Bailhache in favour of a less crazed corsair.

    2. HMS Bailhache may well be sunk before William Bailhache becomes Bailiff unless the current Bailiff, Michael Birt, takes decisive action to eliminate corruption in Jersey, if he can. As Stuart Syvret and others have often said, the problem in Jersey is that many 'have dirt' on others which, depending on the nature, may operate to prevent action being taken where it ought to.

      I do find it interesting that former Constable, Graeme Butcher has been prosecuted recently, presumably to set and example, when there are individuals in high office locally that are alleged and may be provably shown to have committed criminal offences that are far more serious. I think that now, the immediate response to seeing a person of former high standing being subject to disciplinary action or prosecution is that the act is grounded in an attempt to damage their credibility in the eyes of the general public and to encourage the uninformed to believe that the authorities, including the Police, are active in fighting serious crimes such as misconduct in a public office.

Advocate Sinel is quite obviously a genetic anomaly because compared to most Jersey advocates he would appear to have been born with extremely large testicular fortitude and a very real 'spine' unlike most of the fawning amebic jellyfish that defy the gravity. Well done VFC and well done Advocate Sinel for making a stand. Now is it just me or are the wheels in motion to take this little rock to independence of the U.K? First the break with Winchester and now the Treason Law put into the hands of the local Mafia, it really is just a matter of time before 'WE' hear the news "Jersey to go it alone" As S.S has said so many times, You really could not make it up. But what is so very sad is that the lemmings in the states just go along with it.

  11. I really hope that people come forward and speak out I have and will do all the time .the royal court under Clyde -smith and others are so corrupt . My case has been going on for over for years under Clyde - smith he let redacted evidence in so the jurats can read this with no recusal from Clyde - smith and no answer from the system .

    1. It would be helpful to learn more about your case. Is there a reported case available at http://www.jerseylaw.je? I am aware of 'issues' with Commissioner Clyde-Smith. There are, apparently, serious concerns about his conduct in his capacity as a Commissioner of the Royal Court. For my part, I would exercise caution in taking anything Commissioner Clyde-Smith writes down in a judgement without careful scrutiny. The Commissioner seems to operate as a judicial 'whip' under the informal direction of the Bailiff.

    Father time is catching up with Jersey. Well done Advocate Sinel FOR SPEAKING OUT. Fear is the Jersey way. You speak out they will crush you. A line must be drawn. Feudal Jersey must change and will change. The legislature must wake up and realise that the Chief Judge should not be sitting in the states. Anybody who does not realise that shouldn't be allowed to become a states member. Chief Minister Gorst and Senator Ozouf fully understand this. Not good when you are trying to drum up business abroad.

  14. As commented elsewhere I was ejected twice from the Royal Court at the start of a hearing because it "involved children". I objected but that case appeared to be a civil action - not a criminal matter in the name of the Crown Officers. My confusion is even greater now because this case involving the lawyer was clearly a live one at the time of my ejection - was it the same case? I submitted a written representation asking to address the court but although the (UK) Judge was apparently prepared to hear me - there was no way to let me know before that case concluded. Once again the question of "public interest" needs to be raised. I think ALL cases should be open to the public unless there is some good reason against it. If a case involves children - or lawyers - then that is not inevitably a good enough reason . Will this matter be discussed in your video interview? Justice must not only be done - it must be seen to be done and that includes the public seeing it too - how else might we know what goes on in the courts and other secret places that plague this Island's administration.

  15. Advocate Sinel used to be Stuart Syvrets advocate, and in the same nature as Stuart is fearless. Thank goodness there are people like this ( and the blogs ) spearing the way ahead for Jersey society against the oppressive forces of greed, self interest and incompetance of Jersey's Judiciary and certain members of Government.

    1. Yes, "thank goodness" ........ "fearless" maybe. But I imagine that 'indomitable' might be a better word.

      fearlessness could be exhibited by someone who proceeds unaware of the risks. Courage is to know the risks and to still do what you must.

      "once more into the breach" etc. "commute through the lions den" as Health Minister etc etc.

      From snide remarks by the liar Senator Perchard et al, and being stalked by the cowardly death threat troll it ain't no bed of roses.

      I suspect that Stuart Syvret and Advocate Sinel may have in the past had a clash of personalities or even a mismatch of motivation and aim but I do hope that they get together again.

      I do not know them well enough to make a fair comparison but I think that Syvret might win the 'nice guy' competition.

      Both very impressive nonetheless in terms of intellect and backbone.
