Stuart Syvret Court Case State Media Interview (uncut)





Former Jersey Senator, and Health Minister, Stuart Syvret, was once more appearing in Jersey's Royal Court today in a case brought by the Treasury Minister, Senator Philip Ozouf, who's claiming £68,000 supposed Court costs arising out of Mr. Syvret's various attempts to defend himself against the same system that has oppressed and failed so many VULNERABLE PEOPLE IN JERSEY.

Those who have followed the performance of Jersey's so-called  corrupt, politicised and non ARTICLE SIX HUMAN RIGHT COMPLIANT  courts and specifically followers of the "legal" actions consistently brought against Mr. Syvret and in one case "secretly" brought against him, will be aware that the oppressions by Jersey's establishment have left him penniless and without assets.  This does not deter the State from relentlessly pursuing him in court chasing vast amounts of money that they, and everybody else knows, he doesn't have.

It is quite clear, to any reasonable observer, (and the judiciary) that Mr. Syvret has no way of paying these supposed  "costs" arising from his attempts to defend himself against the State,  and the motives behind the pursuance of these monies, and the continuing court actions are highly questionable. Not least, the apparent, non article six Human Right compliant tribunal he was in front of this morning (mentioned in video below).

Bloggers (Jersey's only independent media) attended the Hearing, as did some local State Media (BBC and ITV/CTV). The latter interviewed Mr. Syvret which we filmed in its entirety and offer it to our readers/viewers unedited. Viewers will note that Mr. Syvret had a question of his own for ITV/CTV which has still not been adequately answered.

Regular readers of this Blog will be aware that the State Media published/broadcast a prosecution case (the Wiltshire Report) against (illegally?) suspended former Jersey Chief Police Officer Graham Power QPM.

The "prosecution case" against the Police Chief, which was  broadcast and printed by Jersey State media, was commissioned by the disgraced Home Affairs Minister, Senator Ian Le Marquand, who ultimately dropped  the disciplinary case and in the words of Mr. Power "chickened out of a FAIR FIGHT."

Mr. Power had compiled a 94 page, 62,000 word, interim defence case against the failed and abandoned, politically motivated, disciplinary action. A copy of Mr Power's 94 page report was leaked (by Stuart Syvret) to the discredited, and disgraced BBC (on the 22nd of November 2011) which, despite reporting what was ultimately a failed and abandoned disciplinary case against the Police Chief, the BBC has BURIED MR. POWER'S STATEMENT.

A little known fact is that well over a year ago, Mr. Syvret furnished CTV/ITV, the ITN news franchise in the Channel Island's, with the same document he leaked to the BBC. ITV/CTV also reported on the "prosecution case" against Mr. Power, but just like the BBC has buried the interim defence case and Mr. Syvret, in the interview below, questions CTV/ITV as to when it will be reporting on the many public interest issues revealed in Mr Power's statement and indeed adding balance to the prosecution case it has reported on.

Stuart Syvret Blog Removed by Google (2)

Further to my PREVIOUS POSTING and the Guest Posting on Rico Sorda's BLOG from former Senator, and Health Minister, Stuart Syvret concerning Mr. Syvret's Blog being taken down by Google. Below is an in-depth, and exclusive, video interview with the former Senator.

We discuss, among much more, the confusion as to why Google suspended his Blog in the first place.

Google wrote to Mr. Syvret stating;

"Blogger has been notified that content in your blog:

stuartsyvret.blogspot.com contains allegedly defamatory content that may violate the rights of others and the laws of their country and violates the terms of a court order."

But hang on a minute wasn't he taken to court for alleged Data Protection breaches? Has somebody been duping Google? Mr. Syvret seems to think so. Also discussed is the revelation that the Jersey authorities have been trying to get his Blog taken offline since 2008. Remember 2008 when the Jersey Child Abuse Inquiry (Operation Rectangle) went public and being reported on his Blog? The very same year that the then Chief Police Officer, Graham Power QPM, was dubiously suspended being reported on his Blog? Long before any action was taken against him under the Data Protection Law by four proxies. Did the four proxies, knowingly, or otherwise, give the Jersey authorities the court order it needed to get Google to take the Blog down?

While discussing the cost to the taxpayer, of the authorities attempting to silence him, (since 2008) and the political/judicial tool of bankruptcy, Mr. Syvret tells us about the timing of his court case this coming Friday and makes something of a revelation.

It's also emerged that the 32 posts, Google want removed, and indeed his entire Blog content, will be up on the internet again soon which begs the question just what exactly has the Jersey authorities achieved other than to put Jersey in the spotlight for all the wrong reasons..................AGAIN?

Stuart Syvret Blog Removed by Google.

The Blog of former Senator and Health Minister Stuart Syvret has been removed by Google following a long running campaign by the Jersey authorities to silence him (and others).

Events regarding the removal of the Blog and alternative hosting are still unfolding and I hope to have a Blog up later today explaining how the removal of the Blog came about and related matters like what this could mean for the future of Jersey Blogs.

Submission To Ministry of Justice Select Committee (Part 1).


On the 8th of July 2013 I made a submission to the Ministry of Justice Select Committee as did others to include Deputy Mike Higgins which was published HERE and former Deputy Trevor Pitman which was published HERE. The then Deputy Pitman's submission would only get to see the light of day on his own Blog as with mine it was not accepted by the Select Committee or published on its website.

The three submissions, taken together, provide ample evidence of a BREAKDOWN IN THE RULE OF LAW and good governance in the Crown Dependency of Jersey yet the UK government continue to fail in its obligation to intervene.

The UK Justice Select Committee's Report has now been published (minus a number of submissions and redacted submissions) which can be viewed HERE. Needless to say everything is pretty rosy in Jersey according to the Report.

Here is my submission.

To Ministry of Justice Select Committee on Crown Dependencies developments since 2010.

Following the Committee’s recent visit to Jersey I am motivated to make this submission being very disappointed that the Committee Members have not met with the general public and the Committee chose to meet with government officials almost exclusively.

There is a great deal of discontent on the island that the Committee will only be aware of by meeting with members of the public, especially since there is so little public awareness of the Committee’s task or Terms of Reference.

Most importantly my strongly held view is that there should be MORE intervention and supervision of Jersey Government and administration by outside bodies such as the Privy Council. This especially applies to the administration of justice, the legal system and the lack of impartial tribunals in Jersey.

There are many specific individual cases such as, what many see as the “illegal” suspension of the former Chief Police Officer, Graham Power QPM who’s force was investigating the Haut de la Garenne Child Abuse atrocities. Mr. Power’s suspension has, by the evidence been shown as a political coup in order to discredit him and his Deputy Chief Officer, Lenny Harper, to cover up the atrocities of paedophilia/Child Abuse that were able to go un challenged for decades on this island.

Subsequent to the alleged illegal suspension of Mr. Power, former Health Minister and Senator Stuart Syvret, (opposition politician) has been persecuted over the years for trying to address child protection failures of the State. His injustice, and persecution, continues to this day. This includes “secret” court cases.

Currently Deputies Trevor and Shona Pitman (opposition politicians) face financial ruin as a result of a court case in which the alleged conflicts of a Jurat were not revealed. The same Jurat’s deficiencies were referred to in “The Sharp Report” on Sex abuse at Victoria College where he sought to protect the dignity of a paedophile and refused to look at evidence against the said paedophile, a senior teacher at the college, where the Jurat was also employed.

I have cited, only three instances here to indicate that injustice occurs at senior levels in Jersey’s administration, but I must stress that there are many more instances at all levels in Jersey society where justice is denied. The reasons are many, and include, conflict of interest by those in authority, especially the Crown Officers, obscurity of the laws, lack of adequate legal and political representation.

The Jersey government has embarked on a programme to achieve greater independence from the UK government and UK institutions. This might suit the narrow interest of a few but will definitely NOT be in the interest of the majority of Jersey residents.

Over the centuries islanders have taken their grievances to such bodies as the Privy Council and this facility must be preserved and enhanced. The reliance on the Jersey institutions has proved to be inadequate.

In my view substantial reforms are needed so that the Jersey public have an easier, and more direct access to bodies, such as the Privy Council, and that much clearer guidelines be established to set the parameters for UK supervision and oversight. The Select Committee might not be the body, but there should be established an outside agency more willing to review individual cases that are often termed as “internal matters”

Regarding more general reforms the UK Government should accept, more readily, its responsibility for the good governance of the Crown Dependencies. In Jersey, reforms such as, separation of the Bailiff’s powers, more clearly defined appointment and supervision of all Crown Officers, modernisation of the legal system, abolition of Jurats, removing the monopoly of Jersey lawyers, creation of an adequate Legal Aid system, greater accessibility to independent tribunals and the establishment of a truly democratic States Assembly are all urgently needed. Such reforms seem to be beyond the ability, or outside the current constitutional limits of the prevailing Jersey administration. They will ONLY be achieved following outside intervention.

It is my, strongly held view that the UK is failing in its obligation to ensure good governance and the rule of law in Jersey. Indeed I would go as far as to say the UK is turning a blind eye to, what looks to be political and judicial corruption. The UK has shown it has the power to intervene as it has in Sark and the Turks and Caicos Islands.

Contempt of (Unlawful?) Court.

In our continuing series concerning the court case(s) of former Health Minister, and Senator, Stuart Syvret we bring our readers/viewers another exclusive.

Some will know that stuart Syvret is due in court tomorrow, 4th November 2013 to answer charges of (as far as we're aware) "Contempt of court." Those who have been following this story will be aware that this all stems from a superinjunction, or Data Protection case held in a secret court.

There is much speculation surrounding the question of whether he is going to turn up to this latest Hearing, and journalists from the State Media have been asking him, and others, for information/interviews in order to get the(ir) story out there.

Citizens Media (Jersey's only independent media) once more has the exclusive on this story, and in this exclusive interview Mr. Syvret tells us why the State Media doesn't. He also tells us whether he will be turning up to the (unlawful?) Court Hearing tomorrow morning...........And much more.

Stuart Syvret Demands "Lawful" Court.

It would appear that the State Funded so-called Superinjunction case against former Health Minister, Stuart Syvret, continues to rumble on.

VFC, and a number of local Blogs, (Jersey's only independent media) has reported extensively on this case and even the State Media, in recent weeks, has had to report something about it. Today, once more, we bring our readers/viewers another exclusive.

We are told that Mr. Syvret was scheduled to appear in front of the Royal Court again today in relation to matters concerning the "superinjunction."

He tells us he has only just become aware of this himself after discovering an amount of paperwork/court documents dumped outside his flat door. Exactly what the documents say is still a little unclear as it would appear that Mr. Syvret hasn't, as yet read them, or at least in there entirety, but he does tell us that unless he is granted a "lawful" court hearing he will not be taking part in further actions against him or complying with them and he did not turn up for court today.

No doubt more will unfold, in the coming days/weeks/months but in the meantime we offer this exclusive interview where Mr. Syvret explains the situation from his perspective.

Cost Of Failed, Taxpayer Funded, Super Injunction Remains A Secret.

After more questions asked of alleged Chief Minister, Senator Ian Gorst, by Deputy Trevor Pitman, in the Island's Parliament today we still don't know the full amount, to the taxpayer, of the failed superinjunction placed on former Health Minister Stuart Syvret.

Senator Gorst ducked, and dived, a number of questions surrounding the case with only very little given away. We did, however, find out that the four proxies, it would appear were "invited" by Data Protection Commissioner, Emma Martins to take action against Mr. Syvret.


Data protection commissioner "invited" the claimants to come forward, according to Deputy Mike Higgins. How many other people has she "invited" Will she be inviting Stuart Syvret to make a claim against disgraced former Housing Minister, Deputy Sean Power, after he stole personal data belonging to Mr. Syvret and his ex partner which caused it to be published on a reported paedophile protecting hate-site? No she has already ruled that stealing other people's personal data, sharing it with others, and causing it to be published on the internet is a "regulatory" offence and not criminal.

Senator Gorst also revealed that the four "representors" (proxies) contributed nothing, financially, towards the cost of the case. Which brings us back to a previous posting where we published an extract from the court judgement HERE which read;

"he has put the Representors to unnecessary expense and has failed to engage with the litigation and he has repeatedly breached the order. The consequence of this conduct has been that the Representors have been put to unnecessary expense." 

They were put to NO expense, unnecessary or otherwise. 

Good (unanswered) questions from Deputies Tadier and Higgins also which left Senator Gorst floundering. (recording below)

Stuart Syvret Secret Court Case on State Radio.

Further to our EXCLUSIVE INTERVIEW with former Jersey politician and Health Minister Stuart Syvret concerning the secret court case/super-injunction, BBC Jersey broadcast an edited interview with him this morning on the radio.

The question BBC was asking its listeners was "In the interests of free speech should we be allowed to say anything we like online?"

We have a few others such as;

"Has the Data Protection Law been abused in a secret court case? 

Why did these four proxies not use libel/defamation laws in order to publicly clear their names? 

If justice must be SEEN to be done why was this, taxpayer funded, court case in secret? 

What ramifications could this very dangerous precedent have for journalism across the board, so-called "accredited" and so-called "non accredited journalists alike?

Who brought these very unlikely bedfellows together and what was the motivation?

Is everybody treated equally by the law/Data Protection Office when attempting to make complaints?

How much did this secret court case really cost the taxpayer?

Stuart Syvret, Super-Injunction, and State Media.

After the latest desperate attack on Bloggers from Jersey's only (DISGRACED) "news"paper and as a result of the (not so) secret court case against former Health Minister, Stuart Syvret, finally making it into the local mainstream media we have secured an exclusive interview with Mr. Syvret.

We have decided to publish the interview in two parts, the first part (below) concentrating on the truth behind the myths concerning Jersey's State Media, in that it is the local Blogs, who publish evidence and the State Media who either bury evidence or, as in the case of the Jersey Evening Post (JEP), claim they don't know of the evidence, despite reporting on it a year previously which is demonstrated by fellow Blogger, and Team Voice member Rico Sorda HERE.

Regular readers will not be surprised to learn that not one of Jersey's esteemed "accredited" "journalists" has contacted Mr. Syvret concerning this so-called Super-Injunction despite being aware of it for about 12 months. If this court case could have such huge ramifications for journalism, and free speech, then one HAS to ask WHY NOT?

Part 2 of this interview is an in-depth discussion of the (not so) secret court case or "Super-Injunction." We discuss, in that interview, what it has, or hasn't achieved, who's paying for the court case, who is the real winner of the case and much more. Stuart Syvret Court Case(s) and Judicial/Political Corruption.

In December 2011 VFC INTERVIEWED former Senator, and Health Minister, Stuart Syvret, on his release from prison after being convicted of Data Protection/contempt of court charges. The court case(s) have been described as "politicised and corrupt" and Mr. Syvret a "political prisoner." More about that particular court case can be viewed HERE.

On Mr. Syvret's release from prison, during the interview with VFC he said; "They're going to carry on bringing these kind of corrupt, oppressive, malicious prosecutions against me until they've succeeded in either intimidating me into silence or driving me out of Jersey permanently."

Regular readers will be aware that there is a hugely diverse number of people now coming forward claiming judicial corruption and that Jersey's so-called "justice" system is not fit for purpose. For a breakdown of some of these people claiming to have evidence of judicial/political corruption, which include former and sitting politicians, former Senior Investigating Officer of Jersey's Child Abuse Investigation, members of the public, national and international journalists and others please view THIS which might demonstrate that Mr. Syvret is no longer a lone voice with concerns of political and judicial corruption in the Crown Dependency of Jersey.

Mr. Syvret is now, and has been, involved in a number of court cases (as he predicted in Dec 2011) where he, and others, believe the purpose of some cases is to intimidate him, and others, namely Bloggers (Jersey's only independent media) into silence telling VFC in the interview below, among other things, that although being a litigant in person, it is not unusual for him to receive a five hundred page document and is expected to respond within thirty six hours. Displayed in this latest interview are the eighteen lever-arch folders that concern just one of his court cases and he claims to have many more "possibly hundreds" which would/could be extremely daunting/intimidating to any litigant in person.

Also discussed in this exclusive interview is the apparent dangerous precedents being set by the island's judges (the real power in Jersey) where Mr. Syvret claims investigative journalism and public interest disclosures are being made illegal by the Island's courts by interpreting the democratically approved legislation in a way it was never intended.

The so-called super-injunction and secret court case also get a mention.

Independent Police Force (Terrifying)

Former Senator and Health Minister Stuart Syvret was jailed yesterday (2nd November 2011) apparently for not complying with his Community Service order. This of course is the line taken by Jersey's State Media. However, as is so often the case, the State Media are being a little economical with the full facts.

From the very start Mr. Syvret claimed that the prosecution against him was "a criminal enterprise." After being sentenced to the 80 hours Community Service he claimed to have received evidence, in the form of Former Jersey Police Chief Graham Power's, submission to the Wiltshire Constabulary's DISCREDITED REPORT. Mr. Syvret also claimed that a witness, known to the prosecution, was kept from him which he claims hampered his case.

We are led to believe Mr. Syvret applied for a court hearing to submit all this new evidence but this was denied him by Mr. William Bailhache (Deputy Bailiff) who's brother Philip Bailhache (Former Bailiff) was running against him in the Jersey elections.

Mr. Syvret claims since he was refused this court hearing then he was forced not to comply with his Community Service Order so as he would get brought back to court where he could then submit this new evidence that he claimed to prove the prosecution against him was indeed criminal. However, rightly or wrongly, the Magistrate's Court refused to hear any of this new evidence and jailed him for eight weeks.

But there does appear to be a common thread running through all of this and that is "Child Abuse."  Mr. Syvret was the first politician to speak out against Jersey's Child Protection Failures back in 2007 and as a result of this there is strong evidence to suggest that his removal from office (Health Minister) was engineered by, among others, the very Civil Servants, who he claimed were responsible for these failures.

At the same time as the Former Health Minster was publicly condemning Jersey's Child Protection Apparatus, unknown to him, there was a covert police investigation into Institutional Child Abuse ("Operation Rectangle") in progress headed up by the then Deputy Police Chief Officer Lenny Harper. This was possibly the biggest investigation ever undertaken by a Jersey Police Force where a number of the suspects were people, known as "The Establishment" people who wielded a lot of power and influence in Jersey.............That were never charged.

The rest is well recorded (by Bloggers) History, out of the 151 suspects only a mere 8 of them were ever charged, by what is strongly believed to be a politicised Judicial system where the public were only given a couple of SHOW TRIALS.

The then Chief of Police Graham Power QPM was, "Dubiously"  suspended from duty, Lenny Harper retired, and the State Media went about trashing their names and reputations. All the focus seemed to shift from the Child Abuse that was able to flourish for decades in Jersey's "care" homes onto how much Lenny Harper spent on a Prawn Cocktail in a Bombay Brasserie. The State Media have never set about asking how paedophiles could ply their trade in Jersey's State Run institutions for so long without detection. Indeed the State Media haven't set about asking many questions at all they just repeat, broadcast, publish or print the Press Releases they are given by the State regardless of how preposterous they are.

Below we have part two of Mr. Syvret's evidence given to the Education and Home Affairs Scrutiny Sub Panel (parliamentary Select Committee) who are investigating issues surrounding the Review of financial management of "Operation Rectangle."

We must remember the "State Line" is that Lenny Harper and Graham Power became, overnight, terrible cops who must have completely forgotten all their police training as soon as they started to investigate Child Abuse in Jersey. Or is it, as Mr. Syvret claims in his evidence to Scrutiny, that Mr. Harper and Mr. Power were two straight cops who were going to investigate without fear or favour? Is the truth of all this that these two cops were truly independent and this "terrified" the Jersey Establishment? Is Stuart Syvret spending 8 weeks in prison because he blew the lid off of the Child Abuse atrocities in Jersey? Have the reputations of Lenny Harper and Graham Power QPM been trashed by the Jersey Establishment (and their media) because they blew the lid off of Jersey's "Dirty Secrets?" Has the Home Affairs Minister, Senator Ian Le Marquand, fulfilled his wish and brought the police back under Political Control? Does anybody remember that amongst all this are people who suffered at the hands of paedophiles in State Run "Care" Homes FOR DECADES?

Stuart Syvret, BBC and Community Service


Today saw Senatorial Candidate, Former Senator Stuart Syvret, back in court for allegedly
failing to comply with his Community Service Order imposed on him by the Royal Court of
Jersey for contempt of court.

For those who only get their “news” from Jersey’s State Media it wouldn’t be un-reasonable
to believe that Mr. Syvret is being Non Compliant, however Mr. Syvret, in this exclusive
interview, claims that this is not the case.

Discussed in this interview is why, he believes, he had to take the drastic measure of not
Attending the Community Service. Also discussed is the fact that BBC Jersey have been in
Possession of what Mr. Syvret claims to be “damming evidence” against Jersey’s public
Administration, and the original court case against him which would/could prove Mr.
Syvret’s defence. Furthermore BBC Jersey has had this “evidence" FOR WEEKS.
They’ve not reported a single word of it. Neither have they, to the best of our knowledge
Reported a single word of Mr. Syvret’s 7 page Press Release. (We hope to publish it soon)

We must stress that we have not approached any of those accused by Mr. Syvret in this
Interview and have no doubt they will strongly contest what he has to say. That said we
would be more than happy to interview them should they wish.

In stark contrast to Jersey’s State Media we “Citizens Media” bring you that little more
than a sound bite and strive to have our readers/viewers informed of ALL the facts as we get
them.
