PRESS RELEASE

Deputy Montfort Tadier, Chairman of the Jersey Human Rights Group, has said he has concerns that Jersey's Courts may be breaching Human Rights Laws because there will be no mechanism for the public to attend or view the live proceedings of the courts which would otherwise be in open session.

'Article 6 of European Convention on Human Rights, which is reflected in Jersey Law, states that everyone is entitled to a fair and public hearing in the determination of his/her civil rights and obligations or of any criminal charge against him/her.'

'There is also a public interest that the default position is that court proceedings are held in public. The Courts, like the Parliament, should be open institutions.'

'It is not satisfactory, even at a time of pandemic, that court hearings which would otherwise be public, now be inaccessible. Technology easily allows Court proceedings to be livestreamed, in the same way that States Assembly and scrutiny panel meetings are broadcast.'

'I have sent a request to Ministers to establish livestreaming of the Courts where hearings would normally be in public.'

  4. Deputy Tadier is totally spot on. In the current emergency Governments have assumed extraordinary powers. They have effectively placed most of the population under house-arrest, created secret courts and brought about a climate in which people are told that they have to obey "Government Orders." Nobody should be taking orders from a government.

    We should obey the law and often the law does not turn out be what a government thinks it is. That is what independent courts and human rights laws are for. They allow courts and individuals to put a government back in its box and assert individual rights and traditional freedoms. People have died to establish these rights and we should not give them up easily. Every restriction on freedom should be fully justified before it is imposed.

    As soon as the current emergency subsides governments should be forced, by whatever means are available, to give back every inch of the ground they have taken. My guess is that they will not do it willingly.

  6. Deputy Tadier has broken ranks on an important civil liberties issue amidst the State of Emergency and its Special Powers. Jersey Courts are closed to the public, excluding the possibility of scrutiny and accountability.

    Speaking truth to power takes courage. Jersey is an authoritarian state; a place where justice and elite power are intimately entangled. Prosecutions are highly politicised.

    Jersey has numerous media outlets (JEP newspaper; Bailiwick Express, Channel 103 and the state broadcaster, BBC Radio Jersey), none of which raised any questions about the application of prosecutions and convictions under the Emergency Powers in Courts that are closed to public and press alike. Yet all reported that a man had been prosecuted and fined, without being present. They simply reported verbatim the Law Officers’s Department Press Release. The function of the MSM is to present government policy and state activity to the public.

    Well done Deputy Tadier for doing the job that a legion of local “journalists” could not do.

    There are 49 States Members who should have been raising questions about how government exercises extraordinary powers in a time of crisis. Only one, takes the issue seriously, Deputy Tadier. The others post pictures on Twitter of their pussy curled up in its basket; that’s what passes for ‘serious issues’.

    There are several hundred Advocates and many other lawyers, yet the legal profession stood silent. Well done Deputy Tadier, for speaking out where lawyers are silent.

    There is a civil society that considers itself to be ‘political’, yet avoids discussing inequalities and issues of liberty. Conformism rules the day. It’s easier to design a new face mask than ask how the state is acting in a time of crisis. Well done Deputy Tadier for asking a simple question.

    Let’s hope some questions are asked in the States Assembly tomorrow.

      We know (thanks to Operation Rectangle) not to rely on the Old Media (formerly known as MSM) to question the "justice" system.

      The Old Media won't even defend its own PROFESSION when it (and free speech) is under attack by Donald Bailhache.

  7. So the Hon Police 'broke up' some house-parties this past week? I bet the Little Hitlers amongst them are in their element now. What odds at least some of these house-parties were actual families living under the same roof already? Chuck in these secret courts and the fascists have never had it so good since Adolf's boys were sent packing. Why doesn't Monty also bring some proposals to end the dual role ASAP? The timing would be perfect. Haven't we seen enough of our best politicians screwed by the Bailiffs and their crews in recent years without now letting our wider civil liberties go down the pan?
