Readers who have been following the shambles and out-right injustices the former Police Chief has been subjected to at the hands of our - out of control - government will not be shocked or surprised at this latest turn of events.
It appears that Mr. Graham Power QPM has received word that the Home Affairs Minister, Senator Ian Le Marquand, will be releasing the full redacted version (if that makes sense) of the Wiltshire Report some time tomorrow. In response Mr. Power QPM has issued a Press Release, re-produced (un-redacted) below.
The Wiltshire Report, as regular readers will know, is nothing more than unfounded and unproven allegations against Mr. Power. The same allegations that the Chief Minister, Terry Le Sueur has conceded in the States that Mr. Power is innocent of!
So why start dragging this Wiltshire Report up again? It's finished, over with. It's a million quids worth of tax payers money that Ian Le Marquand has been able to squander on something that is looking more and more like a "personal vendetta" by the day.
Yet again Mr. Power has been denied any notice of this release of the Wiltshire Report, just as he was denied notice, or knowledge of, the first time Senator Le Marquand come out with it.
Furthermore, since Mr. Power has not been consulted, then his agreement to the 62,000 word defence to Wiltshire being published could not have been sought.
Surely Ian Le Marquand has not been allowed to get that "out of control" that he is able to release the Wiltshire Report AGAIN without a single word of Mr. Power's defence being published AGAIN!!?
Furthermore, since Mr. Power has not been consulted, then his agreement to the 62,000 word defence to Wiltshire being published could not have been sought.

MEDIA RELEASE ISSUED BY GRAHAM POWER QPM, FORMER CHIEF OFFICER OF THE STATES OF JERSEY POLICE. THURSDAY 10TH MARCH 2011.
This media release has been issued following information which I have received indirectly from friends in Jersey. I have been told that the Minister for Home Affairs, Senator Ian Le Marquand intends to issue a copy of what is known as the “Wiltshire Report” concerning the abandoned disciplinary investigation into my role in relation to the Historic Abuse Enquiry. I have been told nothing about this release by the Minister or any section of the Jersey Government. In common with the established practice of Ministers in this matter I have been offered no information on what is to be alleged, no representation or any opportunity to respond to what might be said.
I am given to understand that the Minister may attempt to falsely claim that the document he is to release is some form of “independent report” which contains “findings” in respect of my role in the enquiry. None of this is true. The document which I am told is to be released is the “prosecution case” in respect of the disciplinary investigation which produced no disciplinary charges, no disciplinary hearing and was abandoned by the Minister after he had spent over one million pounds of public funds in pursuit of unfounded allegations regarding my role in the attempt to bring justice to the victims of the systematic child abuse conducted by Jersey Government institutions over previous decades. In 2009 I provided the Minister with a comprehensive written response to everything alleged in the Wiltshire report, prior to his abandonment of all disciplinary proceedings. Subsequent to the abandonment of disciplinary proceedings a number of key witnesses in the Wiltshire enquiry have been publically discredited in the Napier report and other revelations.
The Chief Minister has subsequently confirmed in the States that I am to be regarded as innocent of everything which was alleged against me.
Having lost his disciplinary case against me the Minister is now using Ministerial Office and public funds to pursue a personal vendetta.
In some jurisdictions this would be called “Corruption.” In Jersey it appears to be “Government as Usual.”

Why hasn't/doesn't Ian Le Marquand spend as much time and money attempting to bring some justice to the victims of Abuse, as he does on doing everything he can to discredit the very people who tried to do just that?
It is very difficult to find many more appropriate words to describe the Home Affairs Minister's actions - in addition to 'corrupt' - but there are a few.

Ian Le Marquand - when magistrate - routinely sentenced already damaged children to a child custody regime of punitive, coercive solitary confinement - which would sometimes see children held in solitary for months at a stretch.
That practice was illegal.
As confirmed by the Howard league report.
"Conspiracy to pervert the course of justice" - are a few other words.
The manifestly unlawful suspension of the Chief Officer of the Police Force - and the sustaining of that unlawful suspension by Le Marquand - could very easily be seen as a component in a conspiracy to pervert the course of justice - by Jersey's public authorities - as they were an organisation under direct criminal investigation - by the police force led by Graham Power.
"Misconduct in a public office" - could be a few more words to describe the actions of the Home Affairs Minister - in abusing the accepted standards of due process - and vast sums of public money - to pursue an act of political repression - against a decent, straight police officer.
What is increasingly clear - and increasingly undeniable - is that - in the last few years - Jersey's entrenched establishment have become led by a band of wholly inadequate eccentrics - out of all touch with reality - and acting as though we were still in some feudal age.
However - the conduct of the Jersey oligarchy - in oppressing the Police Chief - is going to be a core feature of my legal action.
And the behaviour and conduct of Le Marquand - especially at this moment - can only add to the strength of that case.

Will the Minister, therefore, confirm that as Mr. Power has not been found guilty of anything that he is, in fact, innocent?

It depends on how one describes the term “innocent”, in that it is certainly the case that he has not been proved guilty. He has not had the chance, or no one had the chance, to determine that situation. On the basis that until one is proven guilty one remains innocent in law, then clearly Mr. Power, the former Chief Constable of Police, was, on that basis, innocent and is.

Given the fact that we have heard from the Chief Minister that he was and is innocent, will he be asking the Minister for Home Affairs to make an apology, or will he be making an apology, to an innocent man?

Dear Ian,
I am disappointed to have to communicate with you in this manner but I am really disappointed to learn that you are going release another redacted copy of the Wiltshire Report and ask why?.
You will recall that the Wiltshire Police was tasked at great public expense to conduct an independent disciplinary investigation following Graham Power's suspension. Wiltshire Police took 12 months to conduct the investigation and it was given to you in November 2009. At no time did you take any steps to establish a Discipline Board to enable the allegations to be tested. On 13th July 2010 a month after Mr Power's last day on duty you decided to publish a redacted version of the allegations which you knew could never be contested. You have subsequently revealed that the redaction cost the tax payer over £6,000. Almost immediately after publication you had to withdraw the allegations because of your failure to establish a Discipline Board. In July in answer to an Oral question from Deputy Tadier the Chief Minister stated that Mr Power was innocent of all the allegations.
As a former Magistrate you must be aware that one should not be making allegations unless you are in a position to substantiate them. You are well aware that the allegations have been withdrawn so why continue with what is now giving the appearance of a vendetta at the public's expense.
I ask that you give serious consideration to your intended actions and that you will agree that it defies all natural justice and does little for your credibility. I would also add that we should be directing our attention on the abuse and how it be addressed rather than focusing on those who took the lead in seeking the truth.

Like I have said on my Blog who is left holding the baby. Sen ILM is out their on his own now. He had two choices when he became H A Minister, he chose the wrong one. He could always say damned if he does damned if he doesn't but this mess largely of his own making. He is hell bent on trashing the reputation of Graham Power.

The JEP says that the Wiltshire Report is to be published today - but it does not say when, how or by whom.
ReplyDeleteIf the Home Affairs Minister's true motive for issuing this is to inform the public, then he should have the decency at least to publish Graham Power's response to that report.
Let us not forget that we will see only a significantly redacted copy. We do not know what will have been omitted and the result could well be slanted to sway public opinion.
Remember that this was to have been the evidence used against Graham Power at a disciplinary hearing - at which Mr Power would have been represented and would have had the opportunity to defend himself. The hearing was delayed continually specifically because of the delay in receiving this report. GP has therefore in no way had any opportunity to answer the allegations against him at any time.
So, ILM's only real reason for publishing whatever final redacted version he decides to let us have can only be a cowardly and thoroughly unprofessional continuation of his seemingly God-given mission to destroy the reputations of Messrs Power and Harper.
Is this the sort of behaviour we have come to expect from our Ministers - and ILM in particular? YES it is.
Is this the sort of behaviour we should expect from our Ministers? OF COURSE NOT!
The election later this year should prove interesting ......

Very unusually for Ian Le Marquand, this time, he is letting States Members see it before the "discredited" media. States Members can pick up a hard copy from 11 o'clock this morning. The "discredited" media will get theirs at 2pm. An electronic copy will be up on the States website some time this afternoon.
As far as I am aware, ILM is issuing a statement and won't be available for interview, so that will be good enough for the "discredited" media.........they won't be "door stepping" him!
I think the JEP will present it as a fait accompli.

ReplyDeleteWhat amazes me is that a senior police officer with a long and distinguished career becomes in a short space of time incompetent and unprofessional as ILM would have us believe.If this is really the case why was he appointed in the first place and why did no one spot it before. He had hardly just stepped off the boat,unlike Graball and Worstcop.
Graham Power always came across as the consummate professional but also someone who did not suffer fools gladly.This would be a problem for ILM who almost daily behaves in an unprofessional manner and when he speaks leaves no doubt in ones mind that he is a fool.

The censored version of the full Wiltshire report into the handling of the historical child abuse inquiry by former police chief Graham Power is being published today.
Extracts from the report with the main conclusions were published in July 2010, when the report, carried out by the Wiltshire Constabulary, concluded that Mr Power's supervision of Jersey's biggest police investigation in living memory had been inadequate.
The report was also highly critical of the handling of the media during the inquiry by the senior investigating officer, Lenny Harper.
Mr. Power was suspended in November 2008 but in July 2010 two weeks before the former police chief's retirement, Home Affairs Minister Ian Le Marquand told the States that disciplinary proceedings against him had been abandoned because it would be impossible to finish them in the time available.
the release of the report today has been criticised by both Deputy Bob Hill and Mr. Power.
Ian Le Marquand got owned and exposed by Graham Power QPM on BBC Radio Jersey tonight, for the small minded vindictive little man that he is. With not an ounce of knowledge about natural justice.

ReplyDeleteClearly this is an attempt by the Council of Ministrs to distract from the investigation that is to be made into child abuse in government institutions over decades. That is the issue.
Strange that ILM is keen to have this report released when the COM did not want to undertake an enquiry into the wider issue of the child abuse.
Looks like ILM is loosing his grip. He may have been swayed by the Real Power Holders.

At the end of the day, although I have received legal advice, I am going to make my own decision, as you would expect.
I would assume therefore that he could have said he would not be releasing the rest of the Wiltshire report, because it wasn't right to do so and it would save the taxpayer money, but no, he released it because he had been asked to, pull the other one, time for this clown to dance for the last time.
ILM could have saved the taxpayers £1m+ if only he had demanded to see a (redacted) copy of the so called interim Wiltshire Report which Warcup's letter used to support his complaint.
ILM would not read the ACPO reports and said one of the officers was conflicted, so ILM effectively dismissed it as unreliable.
Yet Warcup's letter to the CEO about Graham Power was not considered as a conflict of interest.

I wanted to make that initial point around the premature nature of the matters but there is a question of whether you personally can preside, not in your capacity as Minister but in your personal capacity because Graham Power has made a complaint against you in which he alleges that you have breached the disciplinary code by making public statements.

Could I be clear, is this in the same terms as the document which I have got addressed to the Chief Minister dated 24th June?
Dr. T. Brain:
Yes, I believe it is. Graham will no doubt tell me if we are incorrect about that. But I was about to say that on taking the advice that Graham Power took, he lodged his complaint with the Council of Ministers through a letter to the Chief Minister dated 24th June. In that letter it was alleged that you had breached paragraph 1.2 of the disciplinary code which requires all parties to maintain confidentiality while proceedings are being progressed. You made a public statement to the States and spoke to the media after you had given Graham Power written notice that you were invoking the disciplinary code. So that is the first observation that we have to make. There is a complaint in being, it is a substantive issue, that you breached ... allegedly breached paragraph 1.2 of the disciplinary code by making public statements. That is a live complaint. At the current time that complaint has been acknowledged but Graham Power has received no further notification about how that matter is being progressed. Consequently, I put it to you that there is now a conflict of interest. While I am convinced you would do your best to deal with these matters in an impartial way, there nevertheless is this underlying conflict of interest, one cannot rule out the possibility of subliminal bias no matter how much one works to avoid that, and consequently it is inappropriate that you chair these proceedings and make the decision. That is our first submission.

A. This is almost worth a book in its own right. Firstly,in November 2008 the new Minister for Home Affairs, Ian Le Marquand, inherited a messed-up suspension and should have put his energy into getting out of the mess rather than digging himself in deeper. The old saying about "holes and digging" applies well here. When wise folk find themselves in a hole they stop digging. Fools send for a bigger spade. Secondly, he was far too "hands off." He might have thought that he was still a Magistrate where he just sat and waited for the evidence to be brought to him

How many of you have downloaded say a music video or 40Mb!!!
What a farce this is, absolute Bulls--t that the file is too big. It is a restrictive measure so those online (almost everyone these days) cannot read it without disclosing your name and address. This must be dealt with in the next States debate.
Call me cynical but if the full wilts cannot be read online (could winzip it) and has to be ordered then not many people will bother. I dont the giving name and adress is more to do with it than laziness.

The earlier part of the Wiltshire Disciplinary Report was in PDF format, but in a manner that allows for copying an image only, ie: one cannot easily reproduce any part of it, in contrast to the Napier Report which one can copy the text.

Yes, the method used for the PDF scan is highly questionable.
ReplyDeleteIf you scan to PDF as text, you get small file sizes. The text can then be copied and pasted afterwards.
If you scan to PDF as an image, you get large file sizes. Every speck of dust or coffee stain on the paper is recorded in digital format, leading to large file sizes, of mostly redundant digital information.
The States of Jersey clearly possess the software than allows users to 'Print to PDF' (hence small text-based PDFs for much of their output) so why was this method not used for the Wiltshire report?
